We also protect our servers with firewalls and data encryption using SSL, and information access authorization controls. Information You provide to Us may be stored on Our secure servers located within or outside India.

However, You understand and accept that there is no guarantee that data transmission over the Internet will be completely secure and that any information that You transmit to Us is at Your own risk. We assume no liability for any disclosure of information due to errors in transmission issues, unauthorized third-party access to our Platform and data bases or other acts of third parties or acts or omissions beyond Our reasonable control and You shall not be entitled to hold the Company responsible for any breach of security except in case of willful negligence on the part of the Company.

BIOMETRIC INFORMATION PRIVACY POLICY

The purpose of this policy is to define the policy and procedures for the collection, use, safeguarding, storage, retention, and destruction of biometric data.

It is Hard Shell Technologies Pvt Ltd. policy to protect, use and store biometric data in accordance with the applicable laws including, but not limited to, the Personal Data Protection Act, 2018 of GoI and rules regulations set by the concern authorities’ .

Hard Shell Technologies Pvt Ltd. (“The Company”) has instituted the following biometric information privacy policy:

Biometric Data Defined

As used in this policy, biometric data includes “biometric identifiers” and “biometric information” as defined in the Personal Data Protection Act, 2018 of GoI . “Biometric identifier” means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. Biometric identifiers do not include writing samples, written signatures, photographs, human biological samples used for valid scientific testing or screening, demographic data, tattoo descriptions, or physical descriptions such as height, weight, hair colour, or eye colour etc.

“Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual. Biometric information does not include information derived from items or procedures excluded under the definition of biometric identifiers.

The Company’s Collection of Biometric Data

The Company, its vendors, and/or the licensor of the Company’s time and attendance software will collect, store, and use biometric data for the purpose of identifying USERs and record time entries when utilizing the Company’s biometric timeclocks or timeclock attachments.

Biometric timeclocks are computer-based systems that scan an USER’s finger prints or hand prints for purposes of identification. The computer system extracts unique data points and creates a unique mathematical representation used to verify the USER’s identity; for example, when the USER arrives at workplace and departs from the workplace.

This data is collected, stored, and used solely for USER identification, Time mapping fraud prevention etc.

Disclosure

To the extent that the Company, its vendors, and/or the licensor of the Company’s , The time and attendance software (Biometric attendance system software) will collect, capture, or otherwise obtain biometric data relating to an USER, the Company/Clients :

  1. Will inform the USER about the reason behind collection, storage, and use of such biometric data .

  2. Will inform the USER of the specific purpose and length of time for which the biometric data is being collected, stored, and used.

  3. Will receive a written release signed by the USER (or his or her legally authorized representative) authorizing The Company, its vendors, and/or the licensor of the Company’s time and attendance software to collect, store, and use the USER’s biometric data for the specific purposes disclosed by The Company, and for The Company to provide such biometric data to its vendors and the licensor of The Company’s time and attendance software.

  4. Will never disclose, redisclose, or otherwise disseminate an USER’s biometric data unless and until :

    1. The USER or the USER’s legally authorized representative consents to such disclosure or redisclosure;

    2. The disclosure or redisclosure completes a financial transaction requested or authorized by the USER or the USER’s legally authorized representative;

    3. The disclosure or redisclosure is required by State or federal law or municipal ordinance; or

    4. The disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.

Retention Schedule

The Company will retain USER biometric data only until, and will request that its vendors and the licensor of The Company’s time and attendance software permanently destroy such data when, the first of the following occurs:

  1. The initial purpose for collecting or obtaining such biometric data has been satisfied, such as the termination of the USER’s employment with The Company, or the USER moves to a new role and responsibility within The Company for which the biometric data is not used; or

  2. Within 1 years of the USER’s last interaction with The Company.

Data Storage, Transmission, and Protection

The Company will store, transmit, and protect biometric data using a reasonable standard of care. Such storage, transmission, and protection from disclosure will be performed in a manner that is the same as or more protective than the manner in which The Company stores, transmits, and protects from disclosure other confidential and sensitive information of The Company and its USERs.

BIOMETRIC INFORMATION PRIVACY RELEASE FORM

The USER named below has been advised and understands that Hard Shell Technologies Pvt Ltd. (“the Company), its vendors, and/or the licensor of the Company’s time and attendance software collect, retain, and use biometric data for the purpose of identifying USERs and recording time entries when utilizing the Company’s biometric timeclocks or timeclock attachments. Biometric timeclocks are computer-based systems that scan an USER’s fingerprint for purposes of identification. The computer system extracts unique data points and creates a unique mathematical representation used to verify the USER’s identity, for example, when the USER arrives at or departs from the workplace.

The Personal Data Protection Act, 2018. Of GoI, regulates the collection, storage, use, and retention of “biometric identifiers” and “biometric information.” “Biometric identifier” means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry or whatever need to as per requirement under the boundaries of rules and regulation set by concerned authority . “Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual.

The USER understands that he or she is free to decline to provide biometric identifiers and biometric information to the Company, its vendors, and/or the licensor of the Company’s for time and attendance software, but that user agreeing to provide such biometric identifiers and information is a condition of employment. The USER may revoke this consent at any time by notifying the Company in writing. However, the undersigned USER further acknowledges that consent to the Company’s collection, storage, use, and retention of biometric data is a condition of Usages. Individuals are free to decline or revoke this consent.

The USER acknowledges that he/she has read the attached Biometric Information Privacy Policy, and that he/she voluntarily consents to the Company’s, its vendors’, and/or the licensor of the Company’s time and attendance software’s collection, storage, and use of biometric data through a biometric timeclock, including to the extent that it utilizes the USER’s biometric identifiers or biometric information as defined, and voluntarily consents to the Company providing such biometric data to its vendors, and/or the licensor of the Company’s time and attendance software.

Company will follow all the rules regulation of Personal Data Protection Act, 2018 set by concern authority In case of any amendment done by Gov will be adopted in a very timely manner .

All the technical parameters has been take care during the development. This Biometric system will works on the basics of computer programming input in case of any data or input failure or technical bugs the company will not be responsible in any change or modification accrued by the such technical failures.

INDEMNITY

You agree to defend, indemnify and hold harmless the Company, and its subcontractors, officers, directors, employees, consultants, representatives and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or expenses (including but not limited to attorneys’ fees and costs) arising directly from

Your use of and access to the Platform;

Your violation of any Terms and the Privacy Policy contained herein;

Your violation of any third party right, including without limitation any copyright, property, or privacy right.

Provided however the same are not on account of fraud, misrepresentation or negligence of the Company or its employees.
